Because of the truly tragic and irreversible consequences of forever losing the companionship, advice, services and support of a loved one, often preceded by an agonizing interval of impairment and suffering by that loved one, Wrongful Death cases are governed not only by the Court-authored principles of negligence law articulated in the personal injury section of this website, but also by specific statutory principles adopted by our New Jersey legislature.
Essentially, once a negligent party's responsibility to pay compensation for the tragedy has been confirmed under common law principles, our State statutes then define the kinds of damages for which compensation can be paid, and the persons eligible to receive it. They do this by categorizing the claimants and their respective damage claims according to two distinct time periods following the accident - the one before, and the one after, the victim's wrongful death....
